Housing Act Delivers Surprise Tax Increase

The Housing and Economic Recovery Act of 2008 delivered a surprise to real estate investors.  Rental property that is converted into a primary residence will no long qualify for the full $250,000/$500,000 tax-free exclusion under Section 121. 

IRS to Scrutinize Partnership Swap & Drop

It appears that further scrutiny is in store for swap and drop strategies.  The IRS has released its draft 2008 Partnership Income Tax Return (IRS Form 1065), which includes two questions targeting 1031 exchange transactions where a partnership completes what is called a swap and drop strategy.  Swap & Drops beware.

Partnership Interests May Qualify for 1031 Exchange!

Partnership interests have always been a challenge when structuring a 1031 exchange.  The IRS now says that the acquisition of 100% of the partnership interests from the partners would qualify as an acquisition of the underlying real property.
