IRS Issues Private Letter Ruling on Deferred Sales Trusts

March 10, 2009--San Diego, California--The Internal Revenue Service (IRS) issued a highly anticipated Private Letter Ruling today that addresses the tax deferral strategy called Deferred Sales Trusts™.

Deferred Sales Trusts provide you with another tax-deferred strategy to defer the payment of your capital gain income tax liabilities when you sell highly appreciated real estate, personal property, business interests or other assets.   The Deferred Sales Trust gives you one more tax deferred strategy to choose from when planning the sale of a highly appreciated property or asset. 

The Deferred Sales Trust, often referred to as a DST, is a contract between you and a trust arrangement called the Deferred Sales Trust in which you sell your real or personal property to the Deferred Sales Trust in exchange for the Deferred Sales Trust’s contractual agreement to pay you a certain amount over a predetermined future period of time.

Deferred Sales Trusts can be a tremendous alternative to the 1031 tax deferred exchange strategy when you are selling highly appreciated property but do not wish to acquire like-kind replacement property as required with a 1031 exchange transaction.

The Deferred Sales Trust will still allow you to sell your property or assets without having to pay your capital gain income tax liabilities in the year in which you sold your property or asset.  You can defer the payment of your capital gain taxes over a predetermined period of time that you negotiate and agree to with the Trustee of the Deferred Sales Trust.

"This tax deferred strategy is drafted pursuant to Section 453 of the Internal Revenue Code and is taxed just like an installment sale contract, but has some very significant advantages over the standard installment sale transaction structured as a seller carry back note," said William L.
